30-Day Freetest VDS - Special Trial Policy
1. Purpose of the Document and Applicable Terms
1.1. This document, the "30-Day Freetest VDS - Special Trial Policy" (the "Special Trial Policy"), establishes the parameters and unique terms of the "30-Day Freetest VDS" Trial Programme (the "Programme").
1.2. This Programme is a Trial Programme within the meaning of the "Peerobyte Trial Policy" (the "Trial Policy"). This Special Trial Policy specifies the Trial Policy as applied to this Programme.
1.3. This Special Trial Policy applies subject to the order of contractual priority established by the Trial Policy. In the event of inconsistencies between this Special Trial Policy and the Trial Policy in relation to the parameters and procedure for providing this Programme, this Special Trial Policy applies, unless the Individual Trial Programme Agreement, the applicable Contract, or mandatory requirements of applicable law provide otherwise. To the extent not regulated by this Special Trial Policy, the Trial Policy, the Agreement, and other applicable Peerobyte documents apply.
1.4. Descriptions of this Programme in instructions, on the Site, in the interface, in tooltips, in banners, in the "Questions and Answers" section, and in advertising and other informational materials do not change this Special Trial Policy, the Trial Policy, or the Agreement and do not constitute an Individual Trial Programme Agreement, unless they expressly show an intention agreed by the Parties to change the terms of this Programme. In the event of inconsistency, the applicable contractual documents prevail in the order established by the Trial Policy.
1.5. The requirements of the Acceptable Use Policy, No Spam Policy, Intellectual Property Policy, and other applicable Peerobyte documents must be complied with in all cases. If this Special Trial Policy contains requirements that are less strict than those documents, the stricter requirements apply, unless mandatory requirements of applicable law provide otherwise.
2. Main Parameters of this Programme
2.1. This Programme is provided at the discretion of Peerobyte and is intended for evaluation of the "Virtual Machines" Service.
2.2. Within this Programme, Peerobyte provides the User with Test Access to the "Virtual Machines" Service.
2.3. Test Access is provided for 30 calendar days. The period is calculated from the date and time of actual deployment of the trial virtual server instance, as recorded in the Peerobyte accounting system, and ends after 30 calendar days on the corresponding date and time according to Peerobyte billing time. If a different time is displayed to the User in the Peerobyte interface, the data in the Peerobyte accounting system prevail, unless mandatory requirements of applicable law provide otherwise.
2.4. As part of Test Access, the User is provided with:
- a virtual server instance with the configuration and limits established by this Special Trial Policy;
- access to the Peerobyte "Virtual Machines" Service control panel;
- access to operating system images;
- the ability to deploy applications from the Peerobyte application store.
2.5. To implement the purposes of this Programme, Peerobyte reflects in the Peerobyte accounting system (billing) in relation to the User Account a Promo Credit with a nominal amount determined by Peerobyte as the estimated cost of 30 calendar days of using the configuration and limits of the Test Resources specified in clause 2.7 of this Special Trial Policy (the "Bonus"). The Bonus is a conditional accounting value and is used exclusively to cover, for accounting purposes, the fixed configuration and limits of the Test Resources within this Programme. The reflection or debit of the Bonus does not constitute the making of the Payment by the User, adding monetary funds to the Account Balance, payment for a Paid Subscription, or a basis for any refund, payout, withdrawal, or compensation. The Bonus cannot be used for other Services, configuration changes, limit increases, payment for a Paid Subscription after the end of Test Access, or withdrawal of funds.
2.6. Withdrawal of the Bonus and any other use of the Bonus not provided by this Special Trial Policy are prohibited.
2.7. Configuration and limits of the Test Resources for Test Access:
- 2 vCPU with dedicated vCPU resources (100%);
- 4 GB RAM;
- 75 GB All-Flash Storage (SSD);
- 5 TB of traffic for the Test Period;
- public IPv4 address: 1;
- backups: 2;
- snapshots: 1;
- available operating system images;
- the ability to deploy applications from the Peerobyte application store.
2.8. The configuration of the Test Resources, limits, and number of included additional capabilities are not increased at the initiative of the User as part of Test Access. Changing the configuration, expanding limits, or adding resources beyond the parameters of this Programme is possible only upon early transition to paid service, if such transition has been confirmed by the User and approved by Peerobyte.
2.9. Test Access is provided on condition that at least one Payment Method is linked to the Account and verified throughout the Test Period. To verify the Payment Method, a verification transaction is performed in the amount and in the manner established by the Agreement. Such verification transaction is not payment for a Paid Subscription or a fee for Test Access.
3. Special VDS Use Cases
3.1. In addition to the general permitted purposes established by the Trial Policy, under this Programme the User may use the Test Resources for the following VDS use cases within the configuration and limits of the Test Resources:
- familiarisation with the Peerobyte "Virtual Machines" Service management interfaces and typical operations for managing a virtual server instance;
- deployment and review of available operating system images;
- deployment of applications from the Peerobyte application store;
- training in OS administration and configuration in a test environment;
- deployment of test, demonstration, and pilot web interfaces and APIs using the public IPv4 address provided under this Programme;
- testing the operation of backups and snapshots within the included quantity;
- integration testing with external test or non-production systems, including webhooks, OAuth/OIDC, external APIs, repositories, and container registries;
- basic performance measurements of the User's own test and pilot environments within the allocated vCPU resources, configuration, limits, and restrictions established by the Trial Policy.
3.2. Under this Programme, the Test Resources must not be used for resale, sublicensing, transfer to third parties as an independent paid infrastructure service, managed service, outsourcing, or other independent commercial provision of Test Resources, or for processing sensitive or regulated data and other purposes prohibited by the Trial Policy, the Agreement, and applicable Peerobyte documents.
3.3. In relation to this Programme, full production operation of Test Resources is permitted within the configuration, limits, Test Period, and other restrictions established by this Special Trial Policy, the Trial Policy, the Agreement, and other applicable Peerobyte documents. Such use of Test Resources in the User's own production processes does not constitute monetisation of Test Resources for the purposes of the prohibition in clause 3.2.
3.4. Load testing, stress tests, mass generation of network traffic, long tests of maximum resource utilisation, and public benchmark testing are permitted only with prior written approval from Peerobyte and within the agreed parameters.
4. Participant Requirements and Activation Procedure
4.1. A User may participate in this Programme if the User meets the requirements of the Trial Policy and has not previously received Test Access under this Programme or any other Peerobyte Trial Programme, and has not previously used Peerobyte Services through the same Account, the same organisation, or other attributes that Peerobyte may take into account in accordance with the Trial Policy, unless otherwise agreed by Peerobyte.
4.2. To activate this Programme, the User must meet the general requirements of the Trial Policy, complete the actions specified in the instruction "How to Activate the 30-Day Freetest VDS Program", and complete the actions in the Peerobyte interface, including acceptance of the Agreement, the Trial Policy, this Special Trial Policy, linking and verification of the Payment Method, and giving consent to automatic transition of Carry-over Resources to paid use and charging of the Payment, unless the User submits an Opt-out.
4.3. After the activation conditions have been met, the Payment Method has been successfully verified, and the Account and User have been approved by Peerobyte, the following consequences occur:
- the Peerobyte accounting system reflects a purpose-specific Bonus in the User's Account Balance for use within this Programme;
- the Peerobyte accounting system debits the Bonus to cover, for accounting purposes, the fixed configuration and limits of the Test Resources within this Programme; such debit does not constitute the making of the Payment by the User;
- a virtual server instance is deployed for the User with the configuration and limits established by this Special Trial Policy;
- in the "Products & Services" section of the Peerobyte service control panel, the User receives access to manage the "Virtual Machines" product;
- the User receives the status of a participant in the "30-Day Freetest VDS" programme.
5. Completion of this Programme and Paid Continuation
5.1. This Programme provides for automatic transition of Carry-over Resources to paid use after the end of the Test Period if Peerobyte has not received an Opt-out before the end of the Test Period in the manner established by the Trial Policy and this Special Trial Policy.
5.2. Carry-over Resources are the resources of the virtual server instance that have been created and not deleted by the end of the Test Period, including the virtual server instance itself, the disk, the public IPv4 address, related backups, snapshots, configurations, and data, if their preservation is technically possible. Unused traffic limits and unused capabilities to create backups or snapshots are not Carry-over Resources, unless otherwise expressly agreed with Peerobyte.
5.3. If Peerobyte has not received an Opt-out before the end of the Test Period, the Carry-over Resources continue to operate on a paid basis under a Paid Subscription to the Peerobyte "Virtual Machines" Service.
5.4. The Paid Subscription is arranged with the following parameters:
- the scope of paid use is determined by the Carry-over Resources at the time of transition, and the Service configuration and limits are set at the level required to preserve such Carry-over Resources, unless otherwise agreed by the Parties;
- the resource unit price and accrual procedure are determined by the current tariffs and the Agreement, unless otherwise agreed by the Parties;
- the payment period is set at 1 month, unless otherwise agreed by the Parties;
- the virtual server instance, data, configurations, network parameters, backups, snapshots, and account and authentication credentials are retained in the form in which they existed at the time of transition to paid service, if this is technically possible and does not breach applicable Peerobyte documents;
- funds for payment of the Paid Subscription are debited from the available monetary part of the Account Balance, if such balance exists and may be used to make the Payment; if such balance is insufficient, the Payment is debited from the Payment Method linked to the Account;
- the Bonus received under this Programme is not included in the available monetary part of the Account Balance and cannot be used to pay for the Paid Subscription.
5.5. No later than 2 calendar days before the end of the Test Period, Peerobyte sends the User a notice of the upcoming end of the Test Period, the composition of Carry-over Resources, the possible consequences of completion, the estimated cost of paid use, and the available methods for refusing paid continuation. The content, delivery channels, and consequences of such notice are governed by the Trial Policy.
5.6. Early transition to a Paid Subscription before the end of the Test Period is permitted on the basis of a ticket submitted by the User through the Peerobyte service control panel and after confirmation by Peerobyte. The transfer of Carry-over Resources to paid service is considered completed from the moment of proper payment for the Paid Subscription and the absence of refusal by Peerobyte to arrange such Paid Subscription, unless Peerobyte has expressly agreed another procedure. From that moment, Test Access is considered completed early, and further use of the resources is governed by the Agreement, applicable appendices, and the Paid Subscription terms.
5.7. The consequences of an Opt-out, non-payment for the Paid Subscription, removal of the required Payment Method, late payment, suspension, and termination of participation are determined by the Trial Policy.
